Section 10 Receiving and Transferring Persons and Items
(1) Anypersontransferredwithintheframeworkofinternationaljudicialcooperationtothe Czech Republic from a foreign state will be received from the foreign authority by the Police of the Czech Republic and handed over to a facility for execution of protective measures or the nearest custody prison, unless this Act stipulates otherwise. This facility or prison will inform the competent court and the public prosecutor conducting supervision in the facility or prison about the placement of this person into their care, and if the person is placed into the prison or facility in the pre-trial state of proceedings under the Code of Criminal Procedure, they will inform also the public prosecutor conducting supervision over maintaining legality in pre-trial proceedings. In relation to take-over of this person they will also take over items belonging to this person from the foreign authority and items, including documents, related to the actions of international judicial cooperation, for which is the person received, if it is possible; otherwise they will proceed pursuant to Sub-section (3).
(2) The person transferred to a foreign state will be taken by the Police of the Czech Republic from the prison or facility for the execution of protective measures and handed over to the foreign authority. In relation to transfer of this person the Police of the Czech Republic will hand over to the foreign authority also items belonging to this person and items, including documents, related to the actions of international judicial cooperation, for which is the person transferred.
(3) The Police of the Czech Republic will hand over to the foreign authority or take over from it items related to the action of international judicial cooperation, if it is not possible or appropriate to send it via the operator of postal services or to transfer it in another way. The Police of the Czech Republic will similarly secure transit of items through the territory of the Czech Republic, including its take-over and hand-over to the foreign authority.
(4) If a person, for which a court has issued an arrest warrant, order for apprehension or order for delivery for execution of a sentence, or concerning who the court took steps aimed towards his delivery for execution of a protective measure associated with incarceration, is to be banished or otherwise transferred according to the law of this state, and the foreign state is willing to transfer this person to the Czech Republic without deciding on his extradition, the procedure of receiving such a person will governed accordingly by Section 83 (1) first and third sentence, or the Police of the Czech Republic may reimburse the foreign state, authorities of which transferred this person to the territory of the Czech Republic, for the costs associated with his transfer. For these purposes may the judicial and central authority provide the foreign authority with necessary information, including personal data and translations of documents.
(5) The person, who is transferred to a foreign authority or received from it pursuant to this Act, does not need to be equipped with a travel document for the purpose of crossing state borders.

Section 131 Takeover of Person from Foreign State
(1) The person transferred by a foreign state for execution of a sentence of imprisonment or protective measure associated with incarceration will be taken over by the authorities of the Prison Service and delivered to a prison or facility for execution of protective measures. The Ministry and the court will be immediately notified thereof.
(2) In case transfer of a person, who is serving an unsuspended sentence of imprisonment or a protective measure associated with incarceration in a foreign state, concerning whom was the foreign decision recognized, into the Czech Republic for the purpose of execution of such a sentence or protective measure did not take place, execution of the recognized foreign decision concerning such a sentence or protective measure in the territory of the Czech Republic will be inadmissible.

Sub-Division 5 Imposition and Execution of Individual Penalties
Section 57 Transfer of a Convict to another Type of Prison
(1) In the course of execution of a sentence of imprisonment may the court decide to transfer an offender to another type of prison, which may differ from the current prison the offender is serving the sentence in by one level.
(2) The court shall decide to transfer a convict to a prison with a lighter regime, if the behaviour of the convict and the manner of fulfilling his/her duties give reason to a conclusion that the transfer shall contribute to his/her reformation.
(3) The court shall decide to transfer a convict to a prison with stricter regime if
a) the convict significantly or repeatedly breached prescribed order or discipline, or
b) the convict was found guilty of a criminal offence committed during execution of the
sentence by a final decision.
(4) From a prison with increased security may not be transferred
a)a convict who was sentenced to imprisonment for life a who has not yet served at least
ten years of the sentence,
b)another convict who is serving the sentence in a prison with increased security before
serving at least one quarter of the imposed sentence.
(5) To a prison with supervision and with surveillance may not be transferred a convict who is to be submitted to a protective institutional treatment on the basis of a court decision, or a convict who was sentenced to banishment.
(6) The court may decide, upon a petition of a convict who has served at least one quarter of the imposed sentence in a prison of a certain type, but at least six months, to transfer him/her to a prison with lighter regime; this does not apply to a convict who was sentenced to imprisonment for life and is serving the sentence in a prison with increased security.
(7) If the petition according to sib-section (6) is not granted, the convict may repeat it no sooner than six months after conclusion of the proceeding on the former petition.
1. Los Estados Partes, de conformidad con lo dispuesto en la presente Parte y con los procedimientos de su derecho interno, deberán cumplir las solicitudes de asistencia formuladas por la Corte en relación con investigaciones o enjuiciamientos penales a fin de:
(f) Proceder al traslado provisional de personas, de conformidad con lo dispuesto en el párrafo 7;
(a) La Corte podrá solicitar el traslado provisional de un detenido a los fines de su identificación o de que preste testimonio o asistencia de otra índole. El traslado podrá realizarse siempre que:
(i) El detenido dé, libremente y con conocimiento de causa, su consentimiento; y
(ii) El Estado requerido lo acepte, con sujeción a las condiciones que hubiere acordado con la Corte.
(b) La persona trasladada permanecerá detenida. Una vez cumplidos los fines del traslado, la Corte la devolverá sin dilación al Estado requerido.
(a) La pena privativa de libertad se cumplirá en un Estado designado por la Corte sobre la base de una lista de Estados que hayan manifestado a la Corte que están dispuestos a recibir condenados;
(b) En el momento de declarar que está dispuesto a recibir condenados, el Estado podrá poner condiciones a reserva de que sean aceptadas por la Corte y estén en conformidad con la presente Parte;
(c) El Estado designado en un caso determinado indicará sin demora a la Corte si acepta la designación.

(a) El Estado de ejecución de la pena notificará a la Corte cualesquiera circunstancias, incluido el cumplimiento de las condiciones aceptadas con arreglo al párrafo 1, que pudieren afectar materialmente a las condiciones o la duración de la privación de libertad. Las circunstancias conocidas o previsibles deberán ponerse en conocimiento de la Corte con una antelación mínima de 45 días. Durante este período, el Estado de ejecución no adoptará medida alguna que redunde en perjuicio de lo dispuesto en el artículo 110;
(b) La Corte, si no puede aceptar las circunstancias a que se hace referencia en el apartado (a), lo notificará al Estado de ejecución y procederá de conformidad con el párrafo 1 del artículo 104.
3. La Corte, al ejercer su facultad discrecional de efectuar la designación prevista en el párrafo 1, tendrá en cuenta:
(a) El principio de que los Estados Partes deben compartir la responsabilidad por la ejecución de las penas privativas de libertad de conformidad con los principios de distribución equitativa que establezcan las Reglas de Procedimiento y Prueba;
(b) La aplicación de normas de tratados internacionales generalmente aceptadas sobre el tratamiento de los reclusos;
(c) La opinión del condenado;
(d) La nacionalidad del condenado; y
(e) Otros factores relativos a las circunstancias del crimen o del condenado, o a la ejecución eficaz de la pena, según procedan en la designación del Estado de ejecución.
4. De no designarse un Estado de conformidad con el párrafo 1, la pena privativa de libertad se cumplirá en el establecimiento penitenciario que designe el Estado anfitrión, de conformidad con las condiciones estipuladas en el acuerdo relativo a la sede a que se hace referencia en el párrafo 2 del artículo 3. En ese caso, los gastos que entrañe la ejecución de la pena privativa de libertad serán sufragados por la Corte.
1. La Corte podrá en todo momento decidir el traslado del condenado a una prisión de un Estado distinto del Estado de ejecución.
2. El condenado podrá en todo momento solicitar de la Corte su traslado del Estado de ejecución.
1. Una vez cumplida la pena, quien no sea nacional del Estado de ejecución podrá, de conformidad con la legislación de dicho Estado, ser trasladado al Estado que esté obligado a aceptarlo o a otro Estado que esté dispuesto a hacerlo, teniendo en cuenta si quiere ser trasladado a éste, a menos que el Estado de ejecución lo autorice a permanecer en su territorio.
2. Los gastos derivados del traslado de conformidad con lo dispuesto en el párrafo 1, de no ser sufragados por un Estado, correrán por cuenta de la Corte.
3. Con sujeción a lo dispuesto en el artículo 108, el Estado de ejecución también podrá, de conformidad con su derecho interno, extraditar o entregar por cualquier otra vía a la persona a un Estado que haya pedido la extradición o entrega para someterla a juicio o para que cumpla una pena.
