TITLE III: DECLARATIONS, RIGHTS, AND GUARANTEES
CHAPTER II: Individual Rights

Article 101
The State shall not authorize the extradition of persons accused of committing
political crimes or related common offenses.

Article 102
No Honduran may be expatriated nor handed over to the authorities of a foreign
state.
Excepted from this provision are cases related with crimes of trafficking of narcotics
in any of their forms, terrorism and any other illegal act of organized crime and when
there exists a Treaty or Convention of extradition with the requesting country.
In no case may a Honduran be extradited for political crimes and related common
offenses.

CHAPTER XII: THE JUDICIAL BRANCH

Article 313
The Supreme Court of Justice shall have the following duties and powers:
4. To take cognizance of cases of extradition and others that must be judged
in accordance with international law

Artículo 102. Ningún hondureño podrá ser expatriado ni entregado por las autoridades a un Estado extranjero.

Se exceptúan de esta disposición los casos relacionados con delitos de tráfico de estupefacientes en cualquiera de sus tipologías, terrorismo y cualquier otro ilícito de criminalidad organizada y cuando exista Tratado o Convenio de extradición con el país solicitante.

En ningún caso se podrá extraditar a un hondureño por delitos políticos y comunes conexos.

Article 102 Use of terms

For the purposes of this Statute:

(b) "extradition" means the delivering up of a person by one State to another as provided by treaty, convention or national legislation.
