Art. 391. (414) El depositario cuidará de que los semovientes den los productos propios de su clase con arreglo a las circunstancias y procurará su conservación y aumento.
Si creyere conveniente la enajenación de todos o de algunos de ellos, pedirá al juez la correspondiente

El juez autorizará la enajenación siempre que el Art. noveno Nº10 inculpado, procesado o tercero civilmente responsable, D.O. 06.12.1989
según corresponda, convenga en ello. Lo decretará contra la voluntad de éstos cuando no hubiere depositario que acepte el cargo y aun sin previa petición del depositario,
cuando los gastos de administración y conservación excedieran de los productos, a menos que el pago de dichos gastos se aseguren suficientemente por el inculpado, procesado, tercero civilmente responsable o por otra

Igualmente, el juez decretará la enajenación de los Art. 9 bienes muebles sujetos a corrupción o susceptibles de D.O. 14.02.1991
próximo deterioro, y de los muebles y semovientes cuya conservación sea difícil o dispendiosa.
1. States Parties shall, in accordance with the provisions of this Part and under procedures of national law, comply with requests by the Court to provide the following assistance in relation to investigations or prosecutions:
(k) The identification, tracing and freezing or seizure of proceeds, property and assets and instrumentalities of crimes for the purpose of eventual forfeiture, without prejudice to the rights of bona fide third parties; and
1. States Parties shall give effect to fines or forfeitures ordered by the Court under Part 7, without prejudice to the rights of bona fide third parties, and in accordance with the procedure of their national law.
2. If a State Party is unable to give effect to an order for forfeiture, it shall take measures to recover the value of the proceeds, property or assets ordered by the Court to be forfeited, without prejudice to the rights of bona fide third parties.
3. Property, or the proceeds of the sale of real property or, where appropriate, the sale of other property, which is obtained by a State Party as a result of its enforcement of a judgement of the Court shall be transferred to the Court.
