Procedures for dealing with documents claimed to be privileged
103.— (1) No claim as to privilege or confidentiality of any documents seized or to be seized under the authority of a search warrant shall be grounds for preventing such seizure or challenging the right of any person acting on the authority of the search warrant to seize the documents.
(2) Where any documents are seized under the authority of a search warrant and any person claims that the documents are subject to a lawful claim of privilege or confidentiality the person having custody of the documents in accordance with this Part shall, immediately upon becoming aware of such a claim, place the documents in a sealed bag or other receptacle and cause the documents to be delivered to the Registrar of the High Court.
''Part IX -MISCELLANEOUS, 50. Requests for international assistance not to be disclosed''
(1) A person who, because of his or her office or employment, has knowledge of -
(a) the contents of a request for international assistance made by a foreign country to Fiji under this Act;
(b) the fact that the request has been made; or
(c) that fact that the request has been granted or refused, shall not intentionally disclose those contents or that fact except if-
(d) it is necessary to do so in the performance of his or her duties; or
(e) the Attorney-General had given his or her approval to the disclosure of those contents or that fact.
(2) A person who contravenes subsection (1) commits an offence and is liable, on conviction, to-
(a) if the person is a natural person-a fine not exceeding $12,000 or imprisonment for a period not exceeding 2 year, or both; or
(b) if the person is a body corporate-a fine not exceeding $60,000.
a) La Cour préserve le caractère confidentiel des pièces et renseignements recueillis, sauf dans la mesure nécessaire à l'enquête et aux procédures décrites dans la demande.
b) L'État requis peut au besoin communiquer des documents ou des renseignements au Procureur à titre confidentiel. Le Procureur ne peut alors les utiliser que pour recueillir des éléments de preuve nouveaux.
c) L'État requis peut, soit d'office, soit à la demande du Procureur, autoriser par la suite la divulgation de ces documents ou renseignements. Ceux-ci peuvent alors être utilisés comme moyen de preuve conformément aux dispositions des chapitres V et VI et au Règlement de procédure et de preuve.
