Article 42 – A fine

1. A fine shall be a monetary penalty .

2. The minimum amount of a fine shall be GEL 2 000. If an appropriate article of the Special Part of this Code provides for imprisonment for up to three years, the minimum amount of the fine shall be at least GEL 500.

3. The court shall determine the amount of a fine according to the gravity of the crime committed and the material status of the convicted person. The material status shall be determined based on the person’ s property , income and other circumstances.

4 . The court shall, in its judgment, refer to the amount of a payable fine in laris .

5. A fine may also be imposed as a supplementary punishment when it is not considered as a supplementary punishment under an appropriate article of this Code, except for a crime under Article 1261 of this Code.

6. If a convicted person evades paying the fine or if the payment cannot be enforced, this punishment shall be substituted by community service, corrective labour , house arrest or imprisonment. At the same time, the period of time during which the convicted person was serving this sentence shall be counted towards the term of the community service, corrective labour or house arrest based on the following calculation: GEL 50 of the imposed fine – 4 hours of community service, one day of corrective labour , one day of house arrest. In addition, if a person maliciously evades the community service, corrective labour or house arrest imposed instead of the fine, it shall be substituted by imprisonment, to the extent and under the procedure determined by this Code for this type of punishment.

7. A fine may not be imposed as basic punishment for domestic violence under Article 1261 of this Code, or for committing domestic crime under 111 of this Code.

Article 3. A national state agency responsible for cooperation between the International Court and Georgia

3. In the course of cooperating with the International Court, the Responsible Agency shall have the authority:

i) to take a decision on a request of the International Court, for the purpose of executing a deprivation of liberty sentence on the territory of Georgia, for accepting the convicted person and executing a fine and/or other reimbursement of expenses imposed by the International Court.;

Article 45. Conditions for execution of decisions of the International Court

2. A sentence by the international Court imposing pecuniary penalties may be executed in Georgia also if the person has a permanent residence abroad but his property is on the territory of Georgia.

Article 52

Procedure for enforcing in the territory of Georgia the judgement of a foreign competent court imposing a fine or forfeiture

1. In making a decision on enforcing in the territory of Georgia the judgement of a foreign competent court imposing a fine or forfeiture, the competent district (city) court shall deliver a ruling on the enforcement of the fine or forfeiture imposed on a person.

2. In delivering a ruling specified in paragraph 1 of this article, the relevant district (city) court shall ensure the conversion into laris of the amount of the fine imposed or of the property to be forfeited under the judgement of a foreign competent court at the exchange rate in effect at the time of the decision.

3. The fine or the property to be forfeited specified in paragraph 2 of this article shall be collected in accordance with the procedure determined by the requesting state.

4. The fine imposed by the competent foreign court shall be paid to the state budget of Georgia, and the forfeited property shall be transferred into state ownership.

5. Property forfeited under this article, upon request, may be transferred to the requesting foreign state if it has a special interest in that property.

6. The rights of third persons with respect to the forfeited property shall be considered during the procedures specified in paragraph 4 and 5 of this article.

Artículo 109 Ejecución de multas y órdenes de decomiso

1. Los Estados Partes harán efectivas las multas u órdenes de decomiso decretadas por la Corte en virtud de la Parte VII, sin perjuicio de los derechos de terceros de buena fe y de conformidad con el procedimiento establecido en su derecho interno.

2. El Estado Parte que no pueda hacer efectiva la orden de decomiso adoptará medidas para cobrar el valor del producto, los bienes o los haberes cuyo decomiso hubiere decretado la Corte, sin perjuicio de los derechos de terceros de buena fe.

3. Los bienes, o el producto de la venta de bienes inmuebles o, según proceda, la venta de otros bienes que el Estado Parte obtenga al ejecutar una decisión de la Corte serán transferidos a la Corte.
