CHAPTER I- DECLARATIONS, RIGHTS AND GUARANTEES
Section 18- The defense by trial of persons and rights may not be violated.
Artículo 18- Ningún habitante de la Nación puede ser penado sin juicio previo fundado en ley anterior al hecho del proceso, ni juzgado por comisiones especiales, o sacado de los jueces designados por la ley antes del hecho de la causa. Nadie puede ser obligado a declarar contra sí mismo;
Art. 96. – Todo procesado ante los tribunales militares debe nombrar defensor.
Al que no quisiere o no pudiere hacerlo, se le designará defensor de oficio por el presidente del tribunal respectivo. Art. 97. – Ante los tribunales militares el defensor deberá ser siempre oficial en servicio activo o en retiro.
En el caso de los retirados la defensa será voluntaria, pero quienes acepten el cargo estarán sometidos a la disciplina militar en todo lo concerniente al desempeño de sus funciones.
Art. 485. – Si de los antecedentes remitidos resultare la probable, existencia del delito, el nombre del presunto imputado y su aprehensión, se hará saber a éste, sin dilación alguna, el derecho que tiene para nombrar defensor. Si no lo hiciese se le nombrará de oficio.
1. In the determination of any charge, the accused shall be entitled to a public hearing, having regard to the provisions of this Statute, to a fair hearing conducted impartially, and to the following minimum guarantees, in full equality:
(d) Subject to article 63, paragraph 2, to be present at the trial, to conduct the defence in person or through legal assistance of the accused's choosing, to be informed, if the accused does not have legal assistance, of this right and to have legal assistance assigned by the Court in any case where the interests of justice so require, and without payment if the accused lacks sufficient means to pay for it;
