7. Objection to proceedings.

It shall not be an objection to any proceedings taken against a person by virtue of the provisions of sections 6 and 7 that under the law in force at the time when and in the place where he is alleged to commit the act of which he was accused or of which he was convicted he could not have been punished therefor.

No person shall be held to be guilty of a criminal offence on account of any act or omission that did not, at the time it took place, constitute such an offence, and no penalty shall be imposed for any criminal offence that is more severe in degree or description than the maximum penalty that might have been imposed for that offence at the time when it was committed.

25. (2) It shall not be an objection to any proceedings against a person under this Act in respect of an offence which, if committed in Antigua and Barbuda, would be punishable as an offence of genocide or as an attempt, conspiracy or incitement to commit such an offence that under the law in force at the time when and in the place where he is alleged to have committed the act of which he is accused or of which he was convicted he have been punished for it.

Article 22 Nullum crimen sine lege

1. A person shall not be criminally responsible under this Statute unless the conduct in question constitutes, at the time it takes place, a crime within the jurisdiction of the Court.

2. The definition of a crime shall be strictly construed and shall not be extended by analogy. In case of ambiguity, the definition shall be interpreted in favour of the person being investigated, prosecuted or convicted.

3. This article shall not affect the characterization of any conduct as criminal under international law independently of this Statute.
