Article 52 – Powers of the President of Georgia
The President of Georgia shall:
pardon convicts;
Article 53 – Countersignature
A countersignature shall not be required for legal acts of the President of Georgia related to:
pardoning convicts;
Article 78 – Pardon
1. Pardon shall be granted by the President of Georgia in relation to an individually defined person, under the procedure established by the edict of the President of Georgia.
2. Under an act of pardon, a convicted person may be released from further serving the sentence, or the sentence imposed on him/her may be reduced or substituted by a more lenient sentence.
3. Under an act of pardon, the record of conviction may be removed from a person who has served the sentence.
Chapter 3 Extradition
Article 25
Status, amnesty and pardon of a person subject to extradition
3. Extradition may not be conducted if an act of pardon has been issued with respect to the crime for which the transfer of the person is requested.
1. Having regard to paragraph 10 of the Preamble and article 1, the Court shall determine that a case is inadmissible where:
(b) The case has been investigated by a State which has jurisdiction over it and the State has decided not to prosecute the person concerned, unless the decision resulted from the unwillingness or inability of the State genuinely to prosecute;
