TITLE II: OF THE RIGHTS AND DUTIES OF THE HUMAN PERSON

No one may be prosecuted, arrested, inculpated or condemned except by virtue of a
law promulgated prior to the acts of which he is accused.

magistrate of the judicial order.

No one may be arbitrarily detained. The judicial power, guardian of individual liberty,
assures the respect for this principle under the conditions provided by the law.

Article 55 Rights of persons during an investigation

1. In respect of an investigation under this Statute, a person:

(d) Shall not be subjected to arbitrary arrest or detention, and shall not be deprived of his or her liberty except on such grounds and in accordance with such procedures as are established in this Statute.
