Title 1 The Republic

Article 37

No one may be detained without proven evidence of having committed a crime, and without a written mandate of [a] judge or authority in charge of the public order, except when it concerns [a] fugitive inmate or [a] criminal [caught] in flagrante delicto; but in any case, they must be placed at the disposition of a competent judge within the peremptory time period of twenty-four hours.

ARTICULO 97.-


Tratamiento durante la declaración El imputado declarará siempre con libertad de movimiento, sin el uso de instrumentos de seguridad, salvo cuando sea absolutamente indispensable para evitar su fuga o daños a otras personas. Esta circunstancia se hará constar en el acta. Asimismo, declarará únicamente con la presencia de las personas autorizadas para asistir al acto o en público cuando la ley lo permita

Article 55 Rights of persons during an investigation

1. In respect of an investigation under this Statute, a person:

(d) Shall not be subjected to arbitrary arrest or detention, and shall not be deprived of his or her liberty except on such grounds and in accordance with such procedures as are established in this Statute.
