Supplementary provisions

26 Meaning of “appropriate judicial officer” and “competent court”

(1) For the purposes of this Part—
“appropriate judicial officer” means—
(a) Repealed
(b)a District Judge (Magistrates’ Courts) designated for the purposes of this Act by the Lord Chief Justice of England and Wales after consulting the Lord Chancellor , or
(c) the Sheriff of Lothian and Borders; and
• “competent court” means a court consisting of an appropriate judicial officer.

(2)The Lord Chief Justice may nominate a judicial office holder (as defined in section 109(4) of the Constitutional Reform Act 2005) to exercise his functions under this section.

Article 87 Requests for cooperation: general provisions

1.

(a) The Court shall have the authority to make requests to States Parties for cooperation. The requests shall be transmitted through the diplomatic channel or any other appropriate channel as may be designated by each State Party upon ratification, acceptance, approval or accession. Subsequent changes to the designation shall be made by each State Party in accordance with the Rules of Procedure and Evidence.
