2) If the accused (defendant) is unable to bear all costs of defence

without impairment to the maintenance necessary for a simple lifestyle

for himself and for his family which he is obliged to support, the court

shall rule on application of the accused (defendant) that he be provided

with a defence counsel the costs of whom shall not or only partly be

borne by the accused (defendant) if and as far as this is necessary in the
