Australia ratified the Rome Statute in 2002. Two detailed statutes were adopted to implement the Rome Statute into domestic law. The International Criminal Court Act 2002 implements the co-operation regime in a full and detailed manner, providing a complete code for dealing with requests received from the ICC. Each type of request is dealt with in a separate Division, with general principles that apply to all requests found in Part 2. The International Criminal Court (Consequential Amendments) Act 2002 amended the Criminal Code, substantially adding to Chapter 8, which was renamed ‘Offences against humanity and related offences.’ The elements of the offences are set out in a full and detailed manner and are substantially based on the Elements of Crimes document of the ICC.
