Section 3 - Crime against humanity

A person who, as part of a broad or systematic assault on civilian population,

(3) takes a person as a prisoner or otherwise deprives him or her of his or her liberty in violation of fundamental provisions of international law or causes the involuntary disappearance of a person who has been deprived of his or her liberty,

Crime against humanity

A person who, as part of a widespread or systematic attack directed against a civilian population,

3) imprisons a person or otherwise deprives him or her of his or her liberty in violation of fundamental rules of international law or causes the enforced disappearance of a person who has been deprived of his or her liberty,

shall be sentenced for a crime against humanity to imprisonment for at least one year or for life.

An attempt is punishable.

Aggravated criminal deprivation of liberty

If, in criminal deprivation of liberty,

1) liberty is deprived for a period longer than 72 hours,
2) serious danger is caused to the life or health of another person, or
3) exceptional cruelty or a threat of serious violence is used,

and the criminal deprivation of liberty is also aggravated when assessed as a whole, the perpetrator shall be sentenced for aggravated criminal deprivation of liberty to imprisonment for at least four months and at most four years.

Artículo 7 Crímenes de lesa humanidad

1. A los efectos del presente Estatuto, se entenderá por "crimen de lesa humanidad" cualquiera de los actos siguientes cuando se cometa como parte de un ataque generalizado o sistemático contra una población civil y con conocimiento de dicho ataque:

(e) Encarcelación u otra privación grave de la libertad física en violación de normas fundamentales de derecho internacional;
