Sweden ratified the Rome Statute in June 2001 and adopted legislation regulating cooperation with the ICC in 2003. In 2004, Sweden also ratified the Agreement on Privileges and Immunities of the ICC. Sweden’s Act on Cooperation with the ICC provides for solid cooperation. Reference is also made to other national legislation, namely the Act on International Legal Assistance in Criminal Matters and the Extradition for Criminal Offences Act. As a result, all cooperation and assistance measures available to the State are also made available to the ICC, providing for a broader cooperation regime than the one envisaged by the Rome Statute. Due attention has been paid to the special nature of the ICC and its requests, especially with regard to the arrest and surrender of persons. Sweden has not yet adopted legislation on the crimes under the jurisdiction of the ICC. At present, only genocide is criminalised in Sweden. The procedure for amendment of the Penal Code has been initiated, but has not been concluded to date.
