CHAPTER III
On crimes against protected persons and assets in the event of armed conflict
Article 610
Whoever, during an armed conflict, uses or orders methods or means of combat that are prohibited or intended to cause unnecessary suffering or superfluous harm, as well as those conceived to cause, or that can be reasonably be expected to cause extensive, lasting and serious damage to the natural environment, compromising the health or survival of the population, or who orders all-out war, shall be punished with a sentence of imprisonment from ten to fifteen years, without prejudice to the relevant punishment for the results caused.

Offences against Protected Persons and Property in the Event of Armed Conflict
Article 610
In the event of an armed conflict, anyone who uses or orders the use of methods or means of warfare that are prohibited, or whose objective purpose is to cause unnecessary suffering or additional harm, as well as those that are intended to cause, or can be reasonably expected to cause, widespread, long-lasting, and grave damage to the natural environment, affecting the health or survival of the population, or orders there to be no quarter, shall be sentenced to ten to fifteen years’ imprisonment, which shall be in addition to any sentence imposed for the damage caused.
2. A los efectos del presente Estatuto, se entiende por "crímenes de guerra":
(b) Otras violaciones graves de las leyes y usos aplicables en los conflictos armados internacionales dentro del marco establecido de derecho internacional, a saber, cualquiera de los actos siguientes:
(xx) Emplear armas, proyectiles, materiales y métodos de guerra que, por su propia naturaleza, causen daños superfluos o sufrimientos innecesarios o surtan efectos indiscriminados en violación del derecho internacional de los conflictos armados, a condición de que esas armas o esos proyectiles, materiales o métodos de guerra, sean objeto de una prohibición completa y estén incluidos en un anexo del presente Estatuto en virtud de una enmienda aprobada de conformidad con las disposiciones que, sobre el particular, figuran en los artículos 121 y 123;
