Article 13
Representatives of States participating in the Assembly and its subsidiary organs and representatives of intergovernmental organizations
1. Representatives of States Parties to the Statute attending meetings of the Assembly and its subsidiary organs, representatives of other States that may be attending meetings of the Assembly and its subsidiary organs as observers in accordance with article 112, paragraph 1, of the Statute, and representatives of States and of intergovernmental organizations invited to meetings of the Assembly and its subsidiary organs shall, while exercising their official functions and during their journey to and from the place of meeting, enjoy the following privileges and immunities:
(a) Immunity from personal arrest or detention;
(b) Immunity from legal process of every kind in respect of words spoken or written, and all acts performed by them in their official capacity; such immunity shall continue to be accorded notwithstanding that the persons concerned may have ceased to exercise their functions as representatives;
(c) Inviolability of all papers and documents in whatever form;
(d) The right to use codes or cipher, to receive papers and documents or correspondence by courier or in sealed bags and to receive and send electronic communications;
(e) Exemption from immigration restrictions, alien registration requirements and national service obligations in the State Party they are visiting or through which they are passing in the exercise of their functions;
(f) The same privileges in respect of currency and exchange facilities as are accorded to representatives of foreign Governments on temporary official missions;
(g) The same immunities and facilities in respect of their personal baggage as are accorded to diplomatic envoys under the Vienna Convention;
(h) The same protection and repatriation facilities as are accorded to diplomatic agents in time of international crisis under the Vienna Convention;
(i) Such other privileges, immunities and facilities not inconsistent
with the foregoing as diplomatic agents enjoy, except that they shall have no right to claim exemption from customs duties on goods imported (otherwise as part of their personal baggage) or from excise duties or sales taxes.
2. Where the incidence of any form of taxation depends upon residence, periods during which the representatives described in paragraph 1 attending the meetings of the Assembly and its subsidiary organs are present in a State Party for the discharge of their duties shall not be considered as periods of residence.
3. The provisions of paragraphs 1 and 2 of this article are not applicable as between a representative and the authorities of the State Party of which he or she is a national or of the State Party or intergovernmental organization of which he or she is or has been a representative.

Los representantes de Estados Partes en el Estatuto que asistan a reuniones de la Asamblea o sus órganos subsidiarios, los representantes de otros Estados que asistan a reuniones de la Asamblea y sus órganos subsidiarios en calidad de observadores de conformidad con el párrafo 1 del artículo 112 del Estatuto de Roma, y los representantes de los Estados y de las organizaciones intergubernamentales invitados a reuniones de la Asamblea y sus órganos subsidiarios, tendrán, mientras se encuentren en ejercicio de sus funciones oficiales y durante el trayecto al lugar de reunión y a su regreso, los privilegios e inmunidades siguientes:
a) Inmunidad contra arresto o detención personal;
b) Inmunidad de jurisdicción de toda índole respecto de las declaraciones que hagan verbalmente o por escrito y los actos que realicen a título oficial, la cual subsistirá incluso después de que hayan cesado en el ejercicio de sus funciones como representantes;
c) Inviolabilidad de todos los papeles y documentos, cualquiera que sea su forma;
d) Derecho a usar claves o cifras y recibir papeles y documentos o correspondencia por correo o en valija sellada y a recibir y enviar comunicaciones electrónicas;
e) Exención de restricciones de inmigración, formalidades de registro de extranjeros y obligaciones del servicio nacional en el Estado Parte que visiten o por el cual transiten en el desempeño de sus funciones;
f) Los mismos privilegios con respecto a las facilidades monetarias y cambiarias que se reconozcan a los representantes de gobiernos extranjeros en misión oficial temporal;
g) Las mismas inmunidades y facilidades respecto de su equipaje personal que se reconozcan a los agentes diplomáticos con arreglo a la Convención de Viena;
h) La misma protección y las mismas facilidades de repatriación que se reconozcan a los agentes diplomáticos en épocas de crisis internacional con arreglo a la Convención de Viena;
i) Los demás privilegios, inmunidades y facilidades compatibles con los que anteceden de que gocen los agentes diplomáticos, con la salvedad de que no podrán reclamar la exención de derechos aduaneros sobre mercaderías importadas (que no sean parte de su equipaje personal) o de impuestos sobre la compraventa o el consumo.
2. Cuando la aplicación de cualquier forma de impuesto dependa de la residencia, los períodos en que los representantes descritos en el párrafo 1 que asistan a reuniones de la Asamblea y sus órganos subsidiarios permanezcan en un Estado Parte en ejercicio de sus funciones no se considerarán períodos de residencia.
3. Lo dispuesto en los párrafos 1 y 2 del presente artículo no será aplicable entre un representante y las autoridades del Estado Parte del que sea nacional o del Estado Parte o la organización intergubernamental del que sea o haya sido representante.
